Other Resources: The Florida Department of Law Enforcement keeps public electronic records of all Intoxilyzer 8000 documents at www.fdle.state.fl.us/atp under "Public Records" and "ARS". Since those records are uploaded electronically, FDLE's website may contain very recent records not immediately available on the State Attorney's Office website. Breath Test Permits, HGN Logs, Uniform Guidelines for Checkpoints, DRE Logs, and DUI Room Key Logs may be available via a public records request of the police agencies, or via subpoena.
PLEASE NOTE: The State reserves the right to refrain from providing any and all non-exculpatory, non-impeachment documents that the State does not intend to introduce in a particular defendant's hearing or trial. The State has the sole discretion to determine what it intends to use at hearing or trial. See Rule 3.220. This document is not a contract and does not obviate a defendant's obligation to investigate his or her own case or to exercise due diligence. We reserve the right to argue that the State's failure to provide any of the documents does not entitle the defense to a State-charged continuance.
