Because of this, under the Florida Criminal Punishment Code, there was no legally mandated jail sentence in this case. Even though not mandated, Bolaños’ six year probationary sentence includes conditions of 364 days in jail and restitution in the amount of $2389.00 to Bank Atlantic within one year after release from his jail sentence. The City of Hialeah Police Department and the fraud investigations unit of Bank Atlantic, the victim in this case, approved and were pleased with this sentence. So are we.” ###
The award is given annually to honor and recognize individuals who have made outstanding contributions to the safety, health and welfare of our community, while exemplifying the principles upon which the Anti-Defamation League was founded. The ADL was founded in 1913 and is one of the nation’s premier human relations organizations, dedicated to combating anti-Semitism, bigotry and hatred, and to building positive intergroup relations. State Attorney Fernandez Rundle will be honored by the influential group during their Aventura Community of Respect Awards Luncheon on Wednesday, December 1, 2010, at the Fairmont Turnberry Isle in Aventura. According to Mel Kartzmer, co-chair of the ADL event, “It is because of leaders such as Katherine that we continue to build a community that advances the cause of human rights and fulfills ADL’s mission of securing justice and fair treatment for all.” “I have always strived to display a passion for high ethical and professional standards, and perhaps most importantly, for a deep sense of social responsibility”, commented State Attorney Fernandez Rundle. “Earlier this year, I created a Hates Crimes Unit within my office in order to secure justice and fair treatment to ALL citizens alike. “I am truly humbled to be recognized by a group that has devoted close to a century to protect the rights of all human beings”. ###
“Law enforcement will be working the streets to make sure that voting in our county is fair and that everyone’s voice is heard. I have set up an election response team that will be out on in the different precincts answering your complaints about any possible election irregularities”, commented State Attorney Fernandez Rundle. To assist in this endeavor, investigators and civilian employees from the State Attorney’s Office will be present throughout the day at numerous voting locations during the scheduled hours of operation of 7:00 a.m. to 7:00 p.m. The State Attorney’s Office will also activate the Voter Protection Hotline on Tuesday morning. Anyone who suspects improper or irregular activities at voting sites is urged to call the Hotline at 305-547-3360. State Attorney Fernandez Rundle added: “The State Attorney’s Office stands ready to act on your behalf to preserve the integrity of your vote and every citizen’s vote.” ###
Victor Rodriguez would induce desperate homeowners into transferring the ownership of their homes to him or his corporations with false promises that he would protect their credit rating from pending or anticipated foreclosure. The homeowners saw this as a way to get back on their feet and possibly save their homes. Once Rodriguez obtained the homeowner’s signature on a transfer deed, Victor Rodriguez would lease the property to unsuspecting renters, collect and keep the money. In one instance, a victim signed legal documents written entirely in English when she could only read and write in Spanish. Our investigation continues since it appears that there are many more victims of this scam. Victor Rodriguez is being held on a 1 million dollar bond and he is charged with: “I’m very proud of our investigator, Richard Burton, and the prosecutors of my recently created Mortgage Fraud Unit who worked to put this case together. I created this specialized unit so that we could bring the power of the law upon individuals like this man, who had no hesitation about stealing the very homes people live in,” commented State Attorney Fernandez Rundle. “In these tough economic times, for someone to prey on frantic home owners, is despicable. When you are looking at losing your home, you are willing to believe almost anyone who appears to offer you some hope. Victor Rodriguez stole what little hope these victims had left.” Anyone who believes they were defrauded by Victor Rodriguez or his company, Fayad Enterprises Inc., or the two law offices with which he was associated, Rodriguez, Perez, and Associates and Legal Clinic for the People Inc., should contact the State Attorney’s Office at 305-547-3360. ###
State Attorney Fernandez Rundle will be honored with the group’s Leadership Award during the Be a Voice annual awards luncheon on Friday, October 29, 2010, at Jungle Island. For the past sixteen years, Be a Voice has been honoring outstanding community leaders for their commitment and dedication to bettering the lives of abused, abandoned, and neglected children with this prestigious award. The award recognizes an elected official whose commitment to the organization and children’s causes is exemplary and worthy of community wide recognition. “Be a Voice knows that our children are a resource that we must nurture for success. The program provides abused, abandoned and neglected kids with support, love, and direction while helping them meet their social, educational, and medical needs”, commented State Attorney Fernandez Rundle. “It truly humbles me to be recognized for my commitment to our children by a group so well-versed in helping develop a pathway to future well-being and success for our most needy.” ###
In response to several citizens’ complaints that the 3½ year police officer was engaging in the solicitation of bribery during traffic stops of motorists who appeared to be driving under the influence of alcohol or who were committing other moving violations, an investigation and surveillance was conducted at the request of Surfside Police Chief David Allen. The usual pattern of activity was that Officer Moreno would selectively stop a vehicle, usually high end, allegedly for driving under the influence of alcohol or committing some other moving violation. Officer Moreno would routinely tell the driver that he had two options. Option One was to be arrested, go to jail, and have his vehicle towed to the impound lot. Option Two offered by the officer was, in lieu of being arrested and going to jail, the officer could have the vehicle towed back to the driver’s residence or towed out of the City of Surfside, and the driver would only have to pay the towing fee. Officer Moreno would then call his brother, Allan Moreno, who drove a tow truck for Tremont Towing. Allan Moreno would respond to the scene, tow the vehicle, and charge the driver anywhere from 180 to 300 dollars. All telephone calls would occur on their private cell phones and there would be no record of the stop being called in to dispatch or of the tow ever being made for Tremont Towing. Surveillance revealed that after Officer Moreno would let the driver go, he would meet up with his brother to receive a percentage of the inflated fees that the driver had been charged for the tow. “We all know that honesty and integrity are the central values of every effective police agency,” said State Attorney Fernandez Rundle. “When an officer uses his badge to intimidate the very citizens he is supposed to protect and serve, he damages the reputation of his department and every one of his fellow officers. In this case, he has also committed a crime. Now we all must work to undo the damage Mr. Moreno created.” Maximo and Allan Moreno have both been charged with three counts of Bribery, a 2nd degree felony. ###
The jury has spoken, and they have justly recommended the death penalty for Ana Maria Cardona. It is continues to be our position that the Court see fit to sentence Cardona to this most appropriate penalty for her role in this horrific and senseless crime of a young defenseless child. ###

City Year Miami was launched in the fall of 2008 as a way to support the Miami-Dade Public School System in its efforts to help youth succeed in school and realize their potential. Since its inception, City Year Miami has worked to create and implement innovative solutions for the most pressing issues facing Miami-Dade County school children. The spirited City Year Opening Day Ceremony sets the tone for an intense year during which the diverse corps members will be united in their passion for and dedication to service. Each member of the 2010-11 City Year corps has committed to serve a minimum of 1,700 hours during his or her ‘city year’ as a mentor and tutor, providing academic tutoring and mentoring to at-risk and low-income children and youth at schools and non-profits throughout Miami-Dade County. “As a board member of City Year Miami, I recognize the importance of investing in education and providing educational support to the children and youth of our community,” commented State Attorney Fernandez Rundle. “The important services that City Year corps members provide helps prepare our children for success in the classroom and as citizens of our great County.” ###
Since November 2006, the State Attorney’s Office and the Miami-Dade Police Department PCIB have been investigating allegations that the Wackenhut Corporation (Wackenhut) was fraudulently billing Miami-Dade County for security of services, which were not being supplied. Metrorail sites were left unsecured, potentially imperiling the safety of Miami-Dade County citizens. Inside the local Wackenhut offices these unsecured security sites were commonly called “Ghost Posts” and were staffed by “ghost” employees. The actions of these individuals facilitated the defrauding of Miami-Dade County of an excess of $76,000 ( sufficient to the investigation to charge RICO), are but a low estimate of what the actions of these 5 employees may have actually have cost the County. The most egregious example of this fraud related to posts which were left uncovered, although Miami-Dade County was billed as if the posts were manned. Guards who were assigned to specific posts did not always remain at their assigned posts for the entire duration of their shift even though documentation indicated otherwise. Many of those guards left their assigned posts and work shifts hours early at the direction of Wackenhut management. All 3 individuals are charged with one count each of R.I.C.O. ###
The Florida Coastal Cleanup began in 1988 as part of the International Coastal Cleanup, a worldwide event developed by the largest marine non-profit organization, the Ocean Conservancy. Dedicated to the preservation of marine life and the health of the oceans, the Ocean Conservancy also uses the project to raise awareness on issues involving pollution. Detailed information is collected during the cleanup that has been pivotal in influencing policy reform as well as other measures important to reducing marine pollution and enhancing the conservation of marine life. “We must all share the responsibility of helping to protect our environment”, commented State Attorney Fernandez Rundle. “Our community has some of the most treasured shorelines anywhere in the world. This is an important cause and a great opportunity to get involved in making this a better and cleaner world for our children and grandchildren.” 200 members of the State Attorney’s Office have volunteered to help collect debris along Hobie Beach on the Rickenbacker Causeway from 9:00 a.m. to Noon. In its first year, the Florida Coastal Cleanup drew more than 10,500 Floridians that cleaned 915 miles of shoreline and collected 194 tons of debris. Since then, the number of volunteers and participating organizations has grown steadily, and the event continues to have a profound and positive impact on communities. ###

Their findings and report regarding their ongoing investigation will be released to the public and discussed at a 3:00 p.m. press conference to be held this afternoon, Thursday, August 5, 2010, in Room 418-S at the Office of the State Attorney in the E. R. Graham Building located at 1350 NW 12th Avenue, Miami. Mr. Sutton survived the incident, but has been blinded and permanently disfigured. The Sutton family adopted the accused when he was but a few days old, and according to his father, always received and enjoyed nothing but love and support. The jury delivered its guilty verdict last night against Christopher Sutton for the planning, killing and maiming of his loving parents. Justifiably, the court has sentenced this cruel individual to the most severe penalty permissible for his participation in this brutal crime - life imprisonment.” ###
On February 2, 2010, 12 year veteran trooper Lawrence had been arrested after an investigation revealed that numerous tickets he submitted to the Miami-Dade court system were for offenses that never occurred. Trooper Lawrence had been a member of Troop E in Miami-Dade County. "The lying and falsification ended today for former Trooper Paul C. Lawrence," said Dade State Attorney Katherine Fernandez Rundle. "When he created these false tickets, he hurt the very people he had previously sworn to protect. He also damaged the reputation of his department and every one of his fellow officers. Contact: Ed Griffith 305-547-0535 03/03/10 Grand Jury Indicts Michelle Spence-Jones - Suspended Commissioner Charged with Bribery Miami (March 3, 2010) - Today, the Miami-Dade County Grand Jury indicted suspended City of Miami Commissioner Michelle Spence-Jones for soliciting money from involved parties in the 2006 attempt to extend the name of Brickell Avenue further north along SE 2nd Avenue in downtown Miami. MDM Hotel Group, Inc., the developers of the Metropolitan Miami office and residential complex in the affected area and the Codina Group Inc., were solicited by then sitting Commissioner Michelle Spence-Jones to donate funds to a particular entity after a contentious March 23, 2006 City Commission meeting wherein the issue was deferred to the next Commission meeting for a final vote. In the interim, Commissioner Michelle Spence-Jones solicited the sum of $25,000 and ultimately deposited those funds into an account accessible to Commissioner Michelle Spence-Jones. She was indicted on the charge of Bribery, a 2nd degree felony. Additionally, Michelle Spence-Jones was also indicted today on the pending charge of Grand Theft 2nd degree, for which she had been previously charged via information on November 13, 2009. There will be no formal press conference relating to these actions of the Grand Jury. However, State Attorney Fernandez Rundle will be available for comment between the hours of 4:30 to 6:00 PM this afternoon. ###
Contact: Ed Griffith 305-547-0535 02/26/10 Assistant State Attorney Susan Dechovitz Selected for "Prosecutor of the Year" Award Miami (February 26, 2010) - Miami-Dade Assistant State Attorney andSenior Trial Counsel Susan Dechovitz has been selected by the Law Enforcement Officers (LEO) Charitable Foundation and the Miami-Dade Chiefs of Police for their prestigious “Prosecutor of the Year” Award.
Ms. Dechovitz, a prosecutor with the State Attorney’s Office for over 30 years, was nominated for the national award by Miami-Dade State Attorney Katherine Fernandez Rundle. Susan has held a number of positions in the office, including in the Juvenile and Felony Divisions, the Organized Crime Unit, the Public Corruption Unit and the Sexual Battery Unit. She was a Felony Division Chief and also served as a Division Chief of the Career Criminal/Robbery Unit. For many years, Susan was a member of the Major Crimes Division, is currently a Senior Trial Counsel, and serves as the Training Director for the office Over the years, Susan has successfully prosecuted numerous cases, including significant prosecutions of serial killers, serial child rapists, and notably one of the killers of Miami-Dade Police Officer Cheryl Seiden. Overall, she has tried over 100 jury trials and approximately one third of those cases have been homicides tried to jury verdict. In her three decades of practice, she has never had an acquittal in a homicide trial. In 2009, Susan successfully prosecuted the three month long trial of State of Florida v. Tavares Calloway, accused in the execution-style and gruesome murders of five victims, each of whom was partially undressed, bound with duct tape, gagged, and blindfolded before being shot and killed. Calloway was convicted on all 5 counts of first degree murder, armed robbery, armed burglary and armed kidnapping; and he now faces the death penalty. Prior to Mr. Calloway’s trial, Susan had already successfully convicted Antonio Clark, a non-shooting defendant in the same quintuple homicide, after a month and one half trial. Clark has already been sentenced to eight life terms in state prison. State Attorney Fernandez Rundle was extremely honored and proud to learn of Susan’s selection for the award, commenting: “There is no question that Susan Dechovitz represents all that the “Prosecutor of the Year” Award symbolizes. She has given over three decades of exemplary service to the people of Miami-Dade County. Her courtroom skills and successes are enviable, and she has earned immense respect from crime victims and their families whose lives she has touched. She is all that a prosecutor should be.” Ms. Dechovitz will be recognized by the LEO Foundation, the Miami-Dade Chiefs of Police, and her peers at a black-tie gala during the LEO Foundation’s tenth annual event on Saturday evening, March 6, 2010, at the Fountainbleau Hotel located at 4441 Collins Avenue in Miami Beach, Florida. Contact: Ed Griffith 305-547-0535 02/04/10 Jury Recommends Death Penalty in Liberty City Execution Style Murders Miami (February 4, 2010) - A Miami-Dade County criminal court jury has recommended that Tavares Calloway, 31, receive the death penalty for each of the five victims murdered execution style in January 1997. Calloway and his crime partner Antonio Clark, had stormed the Liberty City apartment, hogtied each of the five men and duct-taped their mouths close. Calloway’s co-defendant, Antonio Clark, was sentenced to 8 life terms for his actions during this crime. “The jury agreed with prosecutors that Calloway’s methodical act of going from individual to individual and shooting each one in the head was a heinous act meriting the death penalty,” said State Attorney Fernandez Rundle. “The families of the murdered victims have waited since 1997 to begin to put some closure to this awful incident. Throughout this lengthy trial process, after long appeal delays, they have never lost faith that this day would come. The faith that each family member had in Assistant State Attorney Susan Dechovitz’s ability to bring this matter to an appropriate close is only superseded by my own.” This Jury recommendation now goes to the presiding Criminal Court Judge, Judge Dava Tunis for the final sentence. ###

Senator Wilson is the founder and executive director of the 5000 Role Models Project, a drop-out prevention program for minority boys "at risk" of dropping out of school and/or choosing a life of crime. The program operates in Miami-Dade County and Pinellas County Public School. Graduating seniors receive scholarships to the next level of education. Later in the day, State Attorney Fernandez Rundle will participate in the Martin Luther King Jr. Parade and Festival in Liberty City. The MLK parade is held annually and draws thousands of spectators.
